MA Huaide: On the Construction of a Law-Based Government



During the annual sessions of the National People's Congress (NPC) and the National Committee of the Chinese People's Political Consultative Conference (CPPCC), Prof. MA Huaide, a member of the CPPCC National Committee and president of Renmin University of China, stated in an interview: “The construction of a law-based government has been given significant emphasis in this year's government work report. On the one hand, when reviewing the work of 2025, the report highlighted the further advancement of law-based government construction; when outlining the work for 2026, it once again stressed the need to accelerate and deepen this process. Looking ahead, the construction of a law-based government will likely need to focus on three key areas. First, the institutional framework should be further improved through refinements to administrative legislation, which includes accelerating the formulation of an Administrative Procedure Law and an Administrative Basic Code. Second, greater emphasis should be placed on law enforcement, particularly in promoting strict, procedure-based, fair, and civilized practices. This involves dedicated efforts to address a range of enforcement-related issues, including the standardization of administrative law enforcement involving enterprises. Finally, the role of administrative reconsideration, administrative mediation, administrative adjudication, and other mechanisms for resolving administrative disputes should be fully leveraged, with special emphasis on strengthening the primary role of administrative reconsideration. The goal is to resolve as many administrative disputes and various types of conflicts as possible at the grassroots level and within the administrative system itself."
